This has led to considerable confusion as to how Hutchins could have been shot in the torso with a live weapon held by Baldwin if he did not point it in her direction or pull the trigger. As a result, when Hutchins was killed by a gun that Baldwin was holding, the 63-year-old star was immediately viewed as responsible not just for shooting Hutchins but for helping to create a set that allowed such a thing to happen.

In his court filing, Baldwin described being surprised by Matthew Hutchins’ comments on the “Today” show and by hearing that Hutchins was angry about the Stephanopoulos interview. That day, Baldwin also attended and spoke at a memorial service for Halyna Hutchins that was organized by the “Rust” crew. By sharing Matthew Hutchins’ text messages, Baldwin argued that the widower never gave him any hint that he held the actor responsible for his wife’s death, or that he wasn’t initially open to the idea of “Rust” being completed. Baldwin said he arranged for a hotel room for Matthew Hutchins and his son Andros when they came to Santa Fe, New Mexico, after the shooting. “Watching him I just felt so angry,” Hutchins told Kotb about watching the Stephanopoulos interview. Baldwin furthermore said that Oct. 21 was “the worst day of his life,” as he said it has become for Hutchins’ family. In his filing, Baldwin said that, as an actor, he expected to rely on crew members to tell him that the gun was safe to use. Legally, the arbitration filing represents Baldwins’ effort to invoke the indemnification clause of his contract for “Rust,” for which he was also the producer, Variety said. I just feel — are we really supposed to feel bad about you, Mr. Baldwin?” Hutchins said. He said he also told Hutchins he understood if he might have to stop talking to him due to pending litigation. He also said the messages don’t show “anything other than Hutchins’ dignity in his engagement with Baldwin.” Baldwin also claimed that their interactions by phone or by text were only ever “polite, collaborative, and, at times, even warm.”
