Scott Peterson will be back in court Wednesday for final arguments of juror misconduct allegations in hopes of getting a new trial.

The ruling cited “ prejudicial misconduct” by juror Richelle Nice, who allegedly lied about her own history of legal proceedings. Nice was also questioned about the dozens of letters she sent to the defendant after the trial, asking him why he killed his family. In 2000, a then-pregnant Nice sought a restraining order against her boyfriend’s ex-girlfriend because she “feared for her unborn child,” according to court documents.

The last hearing before a judge determines if Scott Peterson should get a new trial was postponed Tuesday after the convicted killer was exposed to COVID.

Peterson was convicted of killing his wife, Laci, and their unborn son, Conner, in 2004. A decision would have been due by the end of September had the hearing gone as planned Wednesday. The Stanislaus County District Attorney’s Office initially said it would seek the death penalty again.

The case was moved to Redwood City because of pre-trial publicity 18 years ago and the appeal remains there.
