The order means that Malta cannot legally deport the couple until proceedings before the ECHR regarding their case have been wrapped up. When their request for asylum was refused, they lived in Malta illegally for a number of years, it said, adding that it will be replying to each of the "incorrect allegations" made by the couple's lawyers. Malta argued that the couple had “failed to produce further evidence to substantiate the principle of non-refoulment”. They raised a claim based on the principle of non-refoulment - the principle in international law stating that a country cannot return asylum seekers to a country where they would likely face persecution - but this claim was rejected on January 12.
